This office will provide legal services to gain restitution of the property on behalf of the Client. Because of the fact-dependent nature of evictions, as an attorney I can never guarantee the success of any given matter, but I will strive to serve you professionally and promptly.
Unless otherwise discussed and invoiced, The Law Office of Jonathan J. Schlegel, Esq. charges $750.00 in Columbus and Cincinnati, $550.00 for Cleveland Housing Court, $750 in Cuyahoga County / Greater Dayton area, $1250 elsewhere, and $2,450 for commercial evictions and all are + court costs per eviction. Court costs vary by county and court, but most charge between $100.00 - $200.00 to file an eviction action.
The agreed upon fees and services are for the Forcible Entry and Detainer (eviction) action ONLY. Second cause (money damages) actions are not part of this agreement. Counter-claims by the defendant, although unusual, are also not covered by this agreement. In the event a matter is no longer a single-cause eviction matter, Client and the attorney must agree on a supplemental fee agreement for continued representation or failing to do so, Client agrees that the attorney may withdraw from the matter until such time that the eviction matter may be reinstituted as a sole cause of action.
The attorney's fee is a FLAT FEE earned upon receipt. The parties agree that the matter is complete when (1) Judgment is awarded in the Client’s favor; (2) An agreed judgment entry is entered into with the Client's consent; (3) Defendant unilaterally performs actions that necessitate a dismissal of the action (e.g. vacates the premises voluntarily prior to the hearing date); (4) Client and Defendant voluntarily agree to terms that necessitate a dismissal of the action; or (5) Client unilaterally chooses to discontinue the matter.
The matter is incomplete when Client has not resolved the matter as indicated above but wishes to discontinue representation by this office. An incomplete matter is entitled to a partial refund of attorney's fees and unused court costs.
As I serve all of Ohio, from time to time I use other well-qualified attorneys to provide representation at the court hearing in any given matter. In some jurisdictions for purposes of expedience, that other attorney may be the filing attorney. I absorb those costs when applicable as part of the flat legal fee. You will never receive an unexpected bill or charge.
Non-legal services, if necessary, are extra. These services are services that landlords typically perform on their own such as Notice Posting. However, if you need additional non-legal services the cost of such services will be discussed before any billing.
